Foster kids interstate move backed by court ruling

A federal court in Texas agreed Tuesday to delay a ruling that would allow foster parents to use interstate foster care placements in Texas for another year.

The state of Texas had sought to suspend the ruling, saying that the state of Texas had failed to file documentation and was likely to seek an emergency stay to block it from going forward.

But the 10th U.S. Circuit Court of Appeals in San Antonio said the Texas attorney general has the authority to halt the decision by saying that federal court rules allow the suspension of decisions that will have a serious impact on foster children.

Texas is in the middle of its legislative session, but the Legislature failed to take action on a legislative proposal to overhaul how foster parents use Medicaid. The legislative session ended this past week.

Accident closes pacific highway in northen nsw

Northerner Chris Sargent died after being hit by a truck near Maribyrnong, Western Australia on Friday night. He was a father and grandfather and was a member of the Maribyrnong Motorcycle Club.

Witnesses have said a truck veered into the off-road motorbike group from behind and slammed into the front passenger side of the motorcycle before speeding off on the main road.

Mr Sargent, of Maribyrnong, was standing with his group on the south side of a busy, wide, off-road motorway.

Mr Sargent had gone for a ride with his son, who has autism and is non-verbal.

Mr Sargent, 54, was on the way to the Maribyrnong Motorcycle Club meeting when the incident occurred on his way from a picnic on the South-East Coast Highway to Maribyrnong.

He passed by a group of people on the back of a motorbike and was wearing reflective clothing, witnesses said.

Mr Sargent, who had been riding his Kawasaki Ninja 250, was pronounced dead about 20 minutes after the collision at the scene, but police said a medical examination indicated he may not have sustained serious injuries in the collision.

In 2013 a 20-year-old man died in Maribyrnong after being hit by a vehicle driven by a man he knew.

Northern nsw mops up after severe storms hit east coast

A huge storm which hit the east coast of Australia on Monday has dumped up to 100 metres of rain across the region, as well as flooding and mudslides.

The storm, which struck off the west coast of New South Wales, hit just outside Adelaide just after 1am local time on Monday (2pm AEDT).

It caused havoc on several NSW towns, causing major traffic delays and roads to buckle.

Police said heavy rain was seen on Sydney's eastern beaches around midday, and heavy rain was likely to hit eastern North Shore Sydney, which was hit by heavy rain.

On the southern beaches of Penrith, Hobart and Townsville, rain was also reported.

It is still not clear if all those affected by Monday's storm have now been evacuated, though all local authorities have declared a state of emergency, with emergency management agencies expected to step in if needed.

Rideshare drivers facing violence and false complaints

"The industry is just a group of people that are united by their love for bikes and their love for the road," said Paul Heintze, president of the California Association of Bicyclists. "They don't feel the pressure."

The organization said ride sharing is growing at double-digit rates, with about 400,000 users at this time, compared with 3 million in 2010.

Livery-less drivers and those who operate more than 30 vehicles face harassment, death threats or have accidents, said Paul Linsko, executive director of the California Public Utilities Commission's Consumer Safety Department.

"There are plenty of times when drivers get in trouble, they're stopped by the police and there is no reason that they couldn't be involved in an accident," said Linsko, who added that his office is working to educate and protect drivers who use ride sharing.

"It's a huge headache for everybody involved," he said.

While ride-share drivers aren't necessarily making an effort to abide by law, he added, people are looking for solutions that take into account consumer privacy.

It's not uncommon for drivers in driver-less vehicles to use smartphone apps or text messaging, rather than waiting for drivers to respond, said Heintze, of the California Association of Bicyclists.

"They're not always aware of who is doing what and who is the person who is being monitored," he said. "There's been a lot of discussion about this. That needs to be addressed. It's one of the most important issues we need to be addressing."

As more people use ride sharing for free, there's an opportunity to do better — especially when it comes to protecting drivers, he added.

For example, the California Association of Bicyclists works with police, county supervisors and courts and offers services for drivers. Those working for both private companies and government include law enforcement agencies, California Public Utilities Commission, local officials and the California Department of Motor Vehicles, officials said.

Heintze said he's received more than 200 complaints since he started the association in February 2012.

But he said he believes the industry has better resources, like the state's Public Utilities Commission, to help drivers. Heintze said he believes rideshare services are a good way to give drivers tips to reduce unnecessary interactions with police.

"If a rider asks for a tip, that's not a crime, so why should they be asked to take a breath test or be subject to a roadside stop?" said Heintze, who said he doesn't know why police won't stop at stop signs when riding a driverless vehicle. "This industry isn't in control of th
